These terms apply to licenses for dance video footage that DanceMediaGroup ("we") grants to you through this website. The German version is a translation for convenience; where they differ, the English version prevails.
1. Who we are and what we offer
DanceMediaGroup licenses the video footage of its member videographers for use on TikTok, Instagram Reels, Facebook Reels and YouTube. The offer is aimed at content creators, businesses and organisations that publish videos. Mandatory statutory rights of consumers remain unaffected.
2. The license
- We grant you a non-exclusive, non-transferable right to use the licensed footage in the video published at the video URL named in your license, on the platform and for the term stated in your license.
- One license covers one video URL. The footage may be used in that video only. You may monetise that video and grow your channel with it.
- The license does not include music or audio. You are responsible for any license or permission needed for the music in your content.
- You may not resell, sublicense, pass on or otherwise make the footage available to third parties, and you may not use it in other videos, on other platforms or after the licensed term.
3. Request and contract
- Your request through the website is not yet a binding order. We check whether we hold the rights to the footage in the video you named.
- The license contract comes into effect when we confirm your request in text form (for example by email). If we do not hold the rights to the specific video, we decline or cancel your request and nothing is charged.
- If your video is not published yet, you send us the final URL as soon as it is online. We then add it to your license.
4. Term
You can choose a monthly, a one-year or a five-year term. The term starts on the date stated in our confirmation and ends automatically at the end of the chosen period unless we agree an extension with you.
5. Prices and payment
Prices are shown in euros per video URL for the chosen platform and term. We send you an invoice with our confirmation. Taxes, if any, are shown on the invoice. The amount stated in our confirmation applies.
6. Revocation by event directors
Event directors may revoke a license if an edit of the footage risks damage to the event. In that case you are charged only for the time of usage.
7. Use outside the license
Use of the footage that is not covered by a license is not permitted. We reserve the right to request removal of such content and to assert further claims.
8. Rights in the footage
All rights in the footage remain with the videographers who are members of DanceMediaGroup. A license grants a right of use only; it does not transfer ownership.
9. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual duties and limited to the foreseeable, typical damage, to the extent permitted by law. We provide the website as available and do not guarantee uninterrupted access.
10. Changes to these terms
We may change these terms for future requests. A license that has been confirmed remains subject to the terms that applied at the time of our confirmation.
11. Governing law and jurisdiction
These terms and all licenses are governed by Swiss law. The place of jurisdiction is Zürich, Switzerland, unless mandatory law provides otherwise.
12. Severability
If a provision of these terms is or becomes invalid, the remaining provisions stay in effect.
